ERISA is the federal law that governs benefit plans. It places a number of obligations upon the plan sponsor and fiduciaries.
Non-ERISA plans are not govern by ERISA and are not subject to requirements. Government entities are exempt from ERISA, church 403b plans and some others may or may not be exempt, depending on the particular circumstances involved.
