IT IS AN OUTRAGE THAT THE TRUSTEES OF A PUBLIC AGENCY WHOSE SOLE RESPONSIBILITY IS TO DISCHARGE THE RETIREMEN BENEFITS' LAW AS WRITTEN IS TAKING AN ACTIVE LOBBYING POSITION ON THE GOVERNOR'S PROPOSAL TO CHANGE THE BENEFIT STRUCTURE OF THE CALPERS. I CALL ON ANY TRUSTEE OF CALPERS TO FIRST RESIGN HIS/HER POSITION AS TRUSTEE AND THEN GO PUBLIC WITH HIS/HER PERSONAL POSITION ON THE GOVERNOR'S PROPOSAL.

In my view it is not appropriate for the Trustees of a public agency to lobby for or against a legislative proposal made by an elected official. The sole duty of a Trustee is to assure that the law is administered as written. It is wrong for a Trustee to be a partisan when it comes to a proposal. The benefit structure of the system is properly left to advocates of various positions as reflected in the retirement statutes. The partisan positions of the most recent proposal will be forthcoming during the legislative sesssion/hearings. The place for the Trustees to speak is at a legislative hearing when questioned on the proposal by members of a committee.

 

It is obvious that these Trustees have shown their bias and that their public comments are designed to assure that the proposal is DOA (dead on arrival). Such behavior undermines the legislative /democratic process.
